By engaging Hartley Power Solutions, you confirm that you have read, understood and agree to the applicable terms, conditions, policies and fees. By accepting a quote or proceeding with any works, you acknowledge and accept these terms. Acceptance of the quote serves as your electronic agreement to these terms.

TERMS OF SERVICE


cancellation

Hartley Power Solutions requires a minimum of 24 hours notice for any cancellation.

Cancellations made within 24 hours of the scheduled booking, or failure to provide reasonable access to the site at the agreed time, may incur a minimum service fee of $150. This fee is to cover time allocated, travel and loss of other booked work.

PAYMENT & DEPOSITS

Payment may be made via bank transfer, card payment or cash. Cash is accepted but not preferred.

For invoices under $1000, payment is required upon completion of work. For invoices over $1000, payment terms are strictly 7 days from the invoice date, unless otherwise agreed in writing.

For jobs over $1000, Any required deposit will be stated in the quote and must not exceed any maximum imposed by applicable law. Where permitted, the deposit may reflect materials that must be specially ordered or obtained before work commences.

Hartley Power Solutions reserves the right to require payment on completion for first time customers.

Customer Responsibilities & Site Access

Customers are responsible for providing accurate and relevant information regarding the property, existing electrical installations and requested works, and must ensure safe and reasonable access to the work area.

Work may be delayed or rescheduled if the site is deemed unsafe, inaccessible, hazardous or unsuitable.

Additional charges may apply where delays or complications arise due to site conditions, restricted access or inaccurate or incomplete information provided by the customer.

LATE & non-PAYMENTS

Invoices not paid by the due date may incur an overdue payment fee of $50 plus interest at a rate of 2% per month (calculated daily) on the outstanding balance until paid in full.

Hartley Power Solutions reserves the right to suspend or cease further work on any overdue account and recover any reasonable costs incurred in the collection of overdue amounts, including debt recovery fees.

Non-mandatory documents may be withheld while an invoice is overdue. Nothing in this clause permits Hartley Power Solutions to withhold any certificate, notice or document that must be provided under applicable law.

OWNERSHIP OF MATERIALS

All materials supplied remain the property of Hartley Power Solutions until full payment has been received.

Until paid for in full, uninstalled materials supplied by Hartley Power Solutions remain its property to the extent permitted by law. Hartley Power Solutions may recover those materials only with the customer’s consent or through lawful recovery procedures. Nothing in this clause authorises entry onto property without lawful permission.

Existing Installations, Unforeseen Conditions & Variations

Existing electrical installations may contain concealed faults, defects, damage, or non-compliant work that may only become apparent during works. Unforeseen faults, conditions, or issues may require additional work, materials, or labour.

Where reasonably practicable, Hartley Power Solutions will discuss any variations and associated costs with the customer and obtain approval before proceeding.

Any variations or additional work must be approved prior to commencement, with approval able to be provided via SMS, email or in person and updated on any quotes and invoices.

Where immediate action is necessary for safety, compliance or to prevent further damage, prior approval may not be possible. The customer will be notified, and approval will be attempted first where reasonably practicable.

Hartley Power Solutions is not responsible for faults, defects, damage, or non-compliant work that existed prior to commencement of works.

WARRANTY

Hartley Power Solutions provides a 12 month workmanship warranty on all completed electrical work.

This warranty does not cover:

  • Customer supplied materials or equipment

  • Damage caused by misuse, neglect or external factors

  • Pre-existing faults or issues outside the scope of works

No warranty is provided whatsoever on materials or equipment supplied by the customer.

All workmanship warranties still apply

Hartley Power Solutions is not responsible for faults, failures or compatibility issues related to these items.

Faults, Concerns & Call-Outs

If a customer has concerns regarding completed electrical works, Hartley Power Solutions will assess the issue and, where applicable, rectify any fault attributable to its workmanship in accordance with applicable consumer guarantees.

Where an investigation determines that the issue is unrelated to Hartley Power Solutions' workmanship, including faults with customer-supplied products or pre-existing conditions, applicable call-out, inspection, labour or other charges may apply.

Customers are encouraged to contact Hartley Power Solutions regarding any concerns so the issue can be assessed before arranging repairs or replacement works.

Customer Supplied Products

Where customers supply electrical products or equipment for installation, Hartley Power Solutions is not responsible for defects, faults, performance issues or manufacturer warranty claims relating to those products.

Any required investigation, removal, replacement or reinstallation resulting from a faulty or unsuitable customer supplied product may incur additional charges.

Hartley Power Solutions is not liable for delays caused by outside reasonable control, including but not limited to weather, supplier delays, site conditions or access issues.

DELAYS

ILLNESS & UNFORESEEN CIRCUMSTANCES

Hartley Power Solutions reserves the right to reschedule or postpone works where illness, emergency or unforeseen circumstances prevent the works from being safely or reasonably completed.

Customers will be notified as soon as reasonably practicable and any affected works will be rescheduled at the earliest suitable opportunity.

Customers acknowledge that no compensation or reimbursement will be provided for any inconvenience, costs or losses arising from such circumstances.

Quote Validity

All quotes provided by Hartley Power Solutions are valid for 30 days from the date of issue.

After this period, pricing and availability may be subject to change and a new quote may be required.

limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

Subject to those rights, Hartley Power Solutions is not liable to the extent that any loss or damage was caused or contributed to by the customer, a third party, pre-existing defects, inaccurate information supplied by the customer, or circumstances beyond Hartley Power Solutions’ reasonable control.

Hartley Power Solutions may take photographs of completed works for record keeping, quality assurance and promotional purposes.

No personal or identifying information will be shared without the customer's consent.
